GENERAL TERMS AND CONDITIONS OF SALE AND WARRANTY
The following terms and conditions of sale and warranty will govern the commercial relations between PLANET POWER TOOLS, SL and THE CLIENT , the latter being duly informed of them by having been provided with a copy by email and on the website www.planetpower.es/conditions .
1. TECHNICAL SPECIFICATIONS OF THE MATERIALS
The purchaser of goods supplied by PLANET POWER TOOLS, SL declares that they are familiar with the models, quality, technical specifications, and dimensions as specified in the catalogs/technical data sheets, including the dimensional tolerances (3% to 5%) permitted for this type of item. Simulations in Dialux should not be considered an exact representation of reality; they are approximations based on generic data.
2. FORMALIZATION OF THE CONTRACT OR ORDER
Orders will not be valid without a signed acceptance form, which will always include the price, delivery time, and payment method. Acceptance sent by the customer via email will be valid and have full legal effect, and will be considered formalized upon receipt of said email.
3. PRICES
The prices listed on the orders refer exclusively to the materials/products detailed and specified therein. The price specified on the order refers to the goods located at the PLANET POWER TOOLS, SL warehouse in Vizcaya, Spain (EXW). These prices do not include shipping costs. If requested by the customer, shipping will be billed as an extra service, and the company will be exempt from any liability for the goods once they leave our facilities. The price of the goods must be increased by the corresponding Value Added Tax (VAT) for domestic sales. It does not include tariffs, customs duties, or other charges.
4. PAYMENT METHOD
Payment for materials supplied by PLANET POWER TOOLS, SL will be made according to the terms and deadlines established in the order. In the case of deferred payment, if the buyer fails to meet any of the established deadlines, the remaining balance will automatically become due, and PLANET POWER TOOLS, SL will be entitled to claim the entire outstanding debt. Failure to pay for the delivered goods will result in the customer paying interest to PLANET POWER TOOLS, SL. This interest will accrue from the date of default and will be at the legal interest rate. Any dispute will be resolved in the courts of Vizcaya (Spain), where the company has its registered office.
5. DELIVERY TIME
The delivery timeframe will be communicated by PLANET POWER TOOLS, SL and will begin counting from the date of order acceptance. In the event of a delay in delivery by PLANET POWER TOOLS, SL, the customer will have the right to return the partially shipped merchandise, provided this is done within two days of acceptance. However, PLANET POWER TOOLS, SL will not be liable for any damages that may have been incurred as a result of the delay in delivery. Delivery times do not include the time it takes the company to deliver the product.
6. DELIVERY METHOD
Shipping costs for the goods sold will be as stated in the order. PLANET POWER TOOLS, SL is not responsible for any damage that may occur during transport if its own transport is not used. Logistics companies offer full coverage insurance for 3% of the value of the goods. PLANET POWER TOOLS, SL has its own cargo insurance that covers damages if it handles the logistics. We will attempt to replace damaged products as soon as possible, after a visual inspection by the company’s expert who confirms the extent of the damage.
7. ORDER CANCELLATION
Once an order is placed, the buyer is obligated to pay. If both parties agree to cancel the order, the buyer is obligated to pay all expenses incurred up to that point. Orders cannot be canceled under any circumstances once manufacturing/ordering of components, parts, or pieces, or shipment of the product, has begun.
8. DELAY IN ORDER COLLECTION
The customer must collect the merchandise within the period established in the order at the PLANET POWER TOOLS, SL warehouses. If the customer is more than fifteen days late in collecting the merchandise, PLANET POWER TOOLS, SL may send it to the customer, charging them the transport costs, and will proceed to invoice the merchandise.
9. RECEIPT OF GOODS
Upon receiving the order, the customer accepts the merchandise. Should any item arrive damaged as a result of transport, this must be noted on the carrier’s delivery slip, and PLANET POWER TOOLS, SL must be contacted within 24 hours, the maximum time allowed to open a claim with the logistics companies. Opening, using, or handling the product implies acceptance of it and its terms of sale. If you are not satisfied with what you have received, you must return it unused and unaltered in its original packaging, properly sealed and protected. Planet Power reserves the right to refuse payment if the merchandise is used, altered, missing labels, damaged, or not in its original packaging. If the customer wishes to reserve the right to accept the merchandise until it has been used, this must be expressly requested and formalized in a contract between the parties.
10. OWNERSHIP OF THE GOODS
The seller retains ownership of the goods supplied until the buyer has paid the full amount due; until then, the goods will be considered held in safekeeping. The goods may be repossessed for non-payment within the previously stipulated period. If repossession is not possible, the conditions outlined in point 4 will apply.
